Terms & conditions

The contractual frame: who commits to whom, how the price is set, when it is charged, and what happens on cancellation.

Document pending legal review

This version has not yet been reviewed by legal counsel. It accurately describes how the platform currently works, but its wording may change before launch.

1. Purpose

These terms govern use of the ValTransfer platform, which connects passengers seeking transport with partner transport companies.

2. Who commits to whom

Everything else follows from this point. ValTransfer does not carry out the transport. The transport contract is formed between the passenger and the partner company that takes the ride. ValTransfer provides the matching, pricing and payment service.

3. Booking

A booking is confirmed once the passenger accepts the trip, the time and the displayed price, and a valid payment method has been authorised. A booking may be declined if no partner company is available for the requested slot, or if an address cannot be located.

4. Price

The price is shown before confirmation and calculated from the estimated distance and duration. It is firm: it does not vary with actual traffic or the actual duration of the ride.

[TO COMPLETE: any surcharges — luggage, animals, waiting time, tolls, night rides — and VAT treatment.]

5. Payment

The payment method is authorised at booking but charged only after the ride has taken place. A booking cancelled before execution results in no charge.

Payment is collected by the partner company carrying out the ride, via Stripe. ValTransfer receives a commission on that transaction.

For bookings far in advance, the payment method is saved with the passenger's consent (3-D Secure strong authentication) and charged after the ride.

6. Cancellation

[TO COMPLETE: free cancellation window, fees beyond it, and no-show policy.] As things stand, a cancelled ride is not charged, and a ride charged in error is refunded, commission included.

7. Passenger obligations

  • Give accurate information, in particular addresses and a reachable phone number.
  • Be present at the agreed address and time.
  • Treat the vehicle and driver with respect. Damage may be invoiced by the company.
  • Comply with applicable law during the ride.

8. Partner company obligations

  • Hold the permits required for professional passenger transport.
  • Assign only drivers whose licences, authorisations and checks are valid.
  • Insure its vehicles and its professional liability.
  • Carry out the booked ride, or give notice without delay if it cannot.

9. Liability

Liability arising from the transport itself — delay, incident, damage, driver conduct — lies with the partner company and its insurer. ValTransfer is answerable for the proper functioning of the platform.

[TO COMPLETE: limitation of liability clause, to be drafted with legal counsel.]

10. Complaints

See Complaints & lost property.

11. Personal data

See Privacy policy.

12. Governing law and jurisdiction

These terms are governed by Swiss law. [TO COMPLETE: place of jurisdiction, to be set with legal counsel.]
